What is FOIA?
The Freedom of Information Act (FOIA) law was implemented in 1967 to empower individuals to request records and information from any government agency. Under this law, agencies must fulfill these requests unless they fall under certain exceptions (for example, if a request might compromise national security or unjustifiably invade a person’s privacy).
State & Open Records Acts Requests:
While the Freedom of Information Act covers all government agencies, each state has developed its own set of rules and guidelines. States may have different exemptions regarding the type of information agencies may release, for example, or stipulations about the timing of when certain kinds of information may be made available.
FOIA and Open Records requests can take time. FOIAs can take up to 6 months to receive a response, while State requests are usually faster.
